Von Riche ("we," "us," "our") operates this website (vonriche.shop). By placing an order, using this website, or signing up to receive text messages or phone calls from us, you agree to these Terms of Service.

1. Products and Orders

All products are sold by Brodigi Media LLC, which operates the Von Riche brand. We reserve the right to refuse or cancel any order at our sole discretion, including orders that appear to contain errors in pricing or product information.

Product descriptions, images, and specifications are provided for informational purposes. We make reasonable efforts to display products accurately but do not guarantee that colors, dimensions, or other details shown on your screen reflect the exact appearance of the product.

2. Pricing and Payment

All prices are listed in USD unless otherwise stated. We reserve the right to change prices at any time without notice. Payment is processed at the time of order through our third-party payment processor. You agree to provide accurate and complete payment information.

3. Shipping, Title, and Risk of Loss

All shipments are made FOB Origin (FOB Shipping Point). This means:

• Title to the goods passes to you at the point of shipment, which is the moment the goods are tendered to the carrier at our supplier's or manufacturer's facility.
• Risk of loss transfers to you at the point of shipment. Once the goods are delivered to the carrier, you bear all risk of loss, damage, or delay during transit.
• We are not liable for any loss, damage, theft, or delay that occurs after the goods have been tendered to the carrier.
• Estimated delivery times are approximate and are not guaranteed.

For the avoidance of doubt, the sale is completed and title transfers at the point of origin (the shipping facility), not upon delivery to your address. This is a shipment contract, not a destination contract.

4. International Shipments

Products may ship directly from international manufacturing or fulfillment locations. You are responsible for any customs duties, import taxes, brokerage fees, or other charges imposed by your country or jurisdiction. These charges are not included in the purchase price or shipping cost.

5. Returns and Refunds

We accept returns within 30 days of delivery, subject to the following conditions:

• Items must be unused, in original packaging, and in resalable condition.
• Personalized, custom, or engraved items are final sale and cannot be returned unless defective.
• To initiate a return, contact us at support@vonriche.com.
• Return shipping costs are your responsibility unless the item was defective or we shipped the wrong product.

Refunds will be processed to the original payment method within 7-14 business days of receiving the returned item. We reserve the right to deduct a restocking fee or refuse returns that do not meet these conditions.

6. Warranties and Disclaimers

ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that products will meet your specific expectations, that product descriptions are error-free, or that any defects will be corrected.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Brodigi Media LLC AND ITS OWNER(S), OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THIS WEBSITE OR PURCHASE OF ANY PRODUCT, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO A PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

8. Intellectual Property

All content on this website, including text, images, graphics, logos, and designs, is the property of Brodigi Media LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

9. Privacy

Your use of this website is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Text Messages and Phone Calls

Our program. If you opt in, Von Riche may send you text messages and call you at the mobile number you give us. Messages and calls may be about your order (for example, a checkout that did not go through, a problem with your card or address, or a check of your engraving details), reminders about items left in your cart, and offers, discounts and new products. Text messages may be sent as standard SMS, as picture messages (MMS), for example a preview image of the personalized item in your cart, or as RCS branded messages on phones and carriers that support them.

How you opt in. You can opt in by:

• ticking the box at checkout that reads "Call or text me if my order gets stuck";
• entering your mobile number in a sign-up form on our website and confirming your subscription.

By opting in, you agree that Von Riche may call and text you at that number, including with automated technology and an artificial or AI-generated voice, about your order and our offers. Your consent is not a condition of any purchase. You confirm that you are the subscriber or the customary user of the number you provide.

Where our messages come from. Our text messages are currently sent from +1 (833) 768-6857. Calls, and the texts that follow a call, come from +1 (213) 259-2549. We may change these numbers; any message from us will identify Von Riche.

Message frequency and cost. Message frequency varies with your activity, for example how many checkouts you start. Message and data rates may apply. Check with your mobile carrier for details of your plan.

How to stop texts. Reply STOP to any text message to stop receiving texts from that number. You can also reply UNSUBSCRIBE, CANCEL, END, QUIT, STOPALL, REVOKE or OPT OUT. We will send one message confirming that you have been unsubscribed, and no further texts from that number after that. To stop all texts and calls from us at once, email support@vonriche.com with the phone number you want removed. If you opt out and later want to rejoin, you can sign up again in the same way you originally did.

Help. Reply HELP to any text, or email support@vonriche.com, for help.

Automated and AI-voice calls. Our calls may be placed with automated technology, and the voice you hear may be an artificial or AI-generated voice rather than a live person. If you ask, our caller will tell you that it is an automated assistant. We call only between 9:00 a.m. and 8:00 p.m. in your local time, based on your shipping address.

Call recording. Calls may be recorded and transcribed, and you will be told this at the start of the call. We and our calling service provider use recordings and transcripts to handle your order, improve our service, keep quality and consent records, and comply with the law. By staying on the call after the notice, you agree to it being recorded.

How to stop calls. Say "stop" at any time during a call, or tell our caller that you do not want to be called. You can also email support@vonriche.com. We will add your number to our internal do-not-call list and honor your request within 10 business days, and usually much sooner. Saying "stop" on a call also stops texts from the number that called you.

Who can take part. The program is for people who are 18 or older. Text messages are sent to U.S. and Canadian mobile numbers; phone calls are made only to U.S. numbers. We do not currently call or text every state or province; where we do not, you will not hear from us even if you opt in.

Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and may depend on your carrier, device and coverage.

Changing your number. If you change or give up the mobile number you opted in with, reply STOP from that number or email us first, so we do not message the next owner of the number.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or your use of this website shall be resolved exclusively in the courts located in the State of Wyoming, and you consent to the personal jurisdiction of such courts.

12. Modifications

We reserve the right to update or modify these Terms at any time. Changes take effect when posted to this page. Your continued use of the website after changes are posted constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
